What Is Severance Pay?
Severance pay is a legal compensation paid by the employer for the period an employee has worked when the employment contract of an employee who meets certain conditions ends. It is regarded as the return for the labor the employee contributed to the workplace and the time that has passed.
Correctly calculated severance pay both ensures legal compliance and completes the exit process in a transparent and secure manner. Incorrect calculation, on the other hand, can lead to both legal disputes and employee grievance.
Conditions for Severance Pay
To be entitled to severance pay, the following conditions are generally required:
- At least 1 year of work: At least 365 days must have been worked for the same employer.
- Appropriate termination of the contract: Situations such as termination by the employer for reasons other than just cause, the employee's justified termination, retirement, military service, or a female employee leaving within 1 year due to marriage give rise to entitlement.
- Working under the Labor Law: The employee is expected to be subject to Labor Law No. 4857.
How Is Severance Pay Calculated?
Severance pay is calculated by multiplying the period worked by the all-inclusive gross wage:
- The employee's total length of service (years, months, days) is determined.
- The latest all-inclusive gross wage (base wage + regular fringe benefits) is calculated.
- For each full year, 30 days of all-inclusive wage is taken as the basis.
- For periods exceeding one year, a proportional (day-based) calculation is made.
- The amount is finalized so as not to exceed the legal severance pay ceiling.
When done manually, these calculations are error-prone because of the ceiling amount and all-inclusive wage items that are updated each period.
