What Is the Annual Leave Entitlement?
Annual paid leave is a legal right that every employee who has worked at least one year can use for rest, the pay for which is covered by the employer. It is guaranteed under the Labor Law and the employee cannot be asked to waive it.
Well-managed leave processes both ensure legal compliance and increase employee satisfaction and productivity. Incorrect tracking of leave balances, on the other hand, can lead to both disputes and operational disruptions.
Annual Leave Durations by Seniority
The number of annual leave days increases with the employee's seniority:
- From 1 year up to 5 years (5 included): At least 14 days
- More than 5 years, less than 15 years: At least 20 days
- 15 years and above: At least 26 days
- Employees under 18 and over 50: At least 20 days
These durations are the legal minimum values; the employer may define more leave through a contract or workplace practice.
How Is Annual Leave Calculated?
Determining the annual leave entitlement follows these steps:
- The employee's start date and total seniority are determined.
- The statutory number of leave days corresponding to the seniority bracket is found.
- Previously used leave is deducted from the balance.
- Carried-over (unused) leave is added to the current balance.
- The current available leave balance is finalized.
In manually kept leave records, mixing up carry-over, accrual and usage records is a common source of error.
